An Analytical Study of the Methodological Similarities and Differences in the Use of Secondary Sources in Fatawa Razawiyyah and Fatawa Darul Uloom Deoband

Abstract

This study examines the use of secondary sources in Fatawa Razawiyyah and Fatawa Darul Uloom Deoband within the framework of Hanafi jurisprudence. Using a qualitative and comparative approach, it analyzes selected legal issues in which both collections rely on Istihsān, ʿUrf, Maslahah,Istishab,Sadd al-Dharā’iʿ,Fath al-Dharā’iʿ and Qaol-e Sahabi.The study finds that both works share a common Hanafi foundation and employ similar secondary sources in Islamic legal reasoning. However, differences appear in the interpretation and application of these sources in certain issues. The analysis highlights that these differences are primarily methodological and reflect varying juristic judgments. The study concludes that both fatwa collections demonstrate the importance of secondary sources in the development of Islamic law and offer valuable insights into contemporary Hanafi legal methodology.
