A Comparative Study of Human Rights Violations against Religious Minorities in Pakistan and India

Abstract

In contemporary South Asia, and especially in Pakistan and India, religious minorities' access to human rights is one of the most salient socio-political and legal issues. In both states, there have been ongoing allegations of discrimination and violence against minority communities, forced conversions and hate speech, political marginalization and inequalities, despite the constitutional guarantees of equality, freedom of religion and protection of minorities. This research paper compares and contrasts the pattern, reasons and impact of human rights abuses suffered by religious minorities in Pakistan and India. This research explores the nature of constitutional structures, state policies, political ideologies, extremist movements, media portrayals, and the involvement of law enforcement institutions in minority experiences in both nations. It also assesses the effects of religious nationalism, majoritarianism and extremist ideology on democratic governance and social cohesion. The paper investigates the nature of extremism in Pakistan and India, and discusses the challenges of the structural and ideological aspects of both countries with regards to the protection of minorities through the use of historical analysis, qualitative comparative methodology and human rights perspectives. The study highlights that institutional reforms, interfaith dialogue, legal protection and depoliticization of religion in the affairs of state, are essential to promoting sustainable peace, democratic stability, and regional harmony.
